Waiver

1. Assumption of Risk

I understand that participation in circus arts, aerial arts, acrobatics, and related physical disciplines involves inherent and significant risk of physical injury. These risks include but are not limited to:

•Falling from aerial apparatus, silks, trapeze, rope, lyra, or other equipment

•Equipment or rigging failure

•Physical contact during spotting, partnering, or acrobatic work

•Muscle, joint, and soft tissue injuries inherent to strenuous physical training

•Use of trampolines, acrobatic mats, and related apparatus

•Injury resulting from the actions of other participants

I knowingly and voluntarily assume all such risks. I agree to use The Actors Gymnasium equipment and facilities in accordance with the supervision, access level, and guidelines designated for my enrollment or session type, whether that is a structured class, supervised open gym, or authorized independent practice.

2. Release of Liability

As a prerequisite to participation in any class, workshop, private lesson, open gym session, camp, intensive, or other programming offered or arranged by The Actors Gymnasium, I hereby waive, to the fullest extent permitted by law, any and all claims and liability which I may have against The Actors Gymnasium, including their directors, officers, employees, agents, independent contractors, subcontractors, suppliers, or other participants — and also against the Noyes Cultural Arts Center, Evanston Arts Council, or the City of Evanston — for injuries, losses, death, or any other personal or property damages arising from my participation, including claims arising from the ordinary negligence of The Actors Gymnasium, its directors, officers, employees, agents, independent contractors, subcontractors, suppliers, facility partners, and related entities. This waiver applies to ordinary negligence but not to gross negligence or willful misconduct.This release shall be binding upon my heirs, legatees, administrators, beneficiaries, and personal representatives. If any part of this agreement is held invalid, the remainder shall continue in full legal force and effect.

3. Medical Disclosure & Health Affirmation

I affirm that I have disclosed to The Actors Gymnasium any known physical conditions, medical limitations, injuries, or medications that may affect my ability to participate safely in programming. I understand it is my ongoing responsibility to inform my instructor of any changes to my health status before each session. I agree not to participate if I am experiencing an acute injury, illness, or any condition that a reasonable person would recognize as making strenuous physical activity unsafe.

4. Communicable Disease

I acknowledge that participation in group physical activities involves the inherent risk of exposure to communicable illnesses. I assume this risk and agree not to hold The Actors Gymnasium liable for any illness contracted as a result of my participation. I agree not to attend programming if I am experiencing symptoms of a communicable illness.

5. Photo & Video Release

I grant The Actors Gymnasium permission to photograph and/or record video of my participation in classes, events, and programming, and to use such images or footage for promotional, educational, and documentary purposes, including but not limited to social media, website, and print materials. I may opt out of this release at any time by notifying The Actors Gymnasium in writing at marketing@actorsgymnasium.org. Opting out does not affect my eligibility to participate in any programming.

6. Admission & Participation Discretion

The Actors Gymnasium reserves the right to exercise discretion in accepting or continuing enrollment for any participant. Participants may be denied entrance or asked to discontinue if, in the professional judgment of the faculty and administration, their participation would pose a danger to themselves or others.

7. Electronic Signature Acknowledgment

If this agreement is completed and submitted electronically, I understand that my electronic submission constitutes a legally binding signature under the Illinois Electronic Commerce Security Act (5 ILCS 175) and carries the same legal weight as a handwritten signature.

8. Governing Law and Venue

This agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Any dispute arising out of or related to this agreement or the participant’s participation in Actors Gymnasium programming shall be brought exclusively in the state courts of Cook County, Illinois, and the parties hereby consent to the personal jurisdiction of such courts.

9. Full Agreement

I have read this document in its entirety and understand that it is a legally binding agreement. I understand that by signing, I am voluntarily waiving substantial legal rights, including the right to sue The Actors Gymnasium and its related parties for injuries or damages arising from my participation, including claims based on ordinary negligence. I am signing this agreement freely and voluntarily, without duress or inducement, and acknowledge that no representations have been made to me other than those contained in this document.

Minor Participant — Parent or Legal Guardian Consent

If the participant is under 18, this section must be completed by a parent or legal guardian. By
signing below, the guardian affirms that they have read and understood this agreement in full,
consent to the minor’s participation in all Actors Gymnasium programming, and agree to all
terms on behalf of the minor and themselves. The guardian further agrees to indemnify and hold harmless The Actors Gymnasium, its directors, officers, employees, agents, and independent contractors from any and all claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or resulting from any claim brought by or on behalf of the minor participant. This release and indemnification shall be binding upon the guardian's heirs and personal representatives.
